What happens without a Thai will

  1. 01

    Thai property follows Thai law.

Inheritance of a condo or land in Thailand is governed by Thai law. A will made at home has to be translated, legalised and presented to a Thai court.

  2. 02

    The account is frozen.

As a rule, Thai banks freeze an account once they learn of the owner's death and release the money only to an estate administrator appointed by the court.

  3. 03

    An unregistered partner inherits nothing.

A marriage in Thailand is valid only once it is registered. A partner without a registered marriage receives property only if named in a will.

  4. 04

    Deadlines are short.

As a rule, an heir must claim the estate within 1 year of the death or of learning about it, and no later than 10 years after the death.

How Thai inheritance law works

The essentials from the Civil and Commercial Code, the Land Code, the Condominium Act and the Act on Conflict of Laws. Checked on 17 October 2026.

Requirements change. We check them against official sources before every application.

  • Five forms of will

Ordinary written will: dated and signed before two witnesses present at the same time. Holographic will: you write the whole text, the date and your signature by hand, no witnesses needed. Public and secret wills: made through the district office (amphur) before two witnesses. Oral will: only in exceptional circumstances.

    Source: Civil and Commercial Code, ss. 1656, 1657, 1658, 1660, 1663 (ThaiLawOnline)

  • Witnesses receive nothing

A witness, the person who wrote the will and their spouses cannot benefit under that will. Witnesses must be adults (as a rule, 20 or older) with full legal capacity. If a witness or the writer benefits, or the form is not followed, the will or that clause is void.

  • Real estate follows the law where it is

Succession to immovable property is governed by the law of the country where it is located. Movable property, such as money in bank accounts, follows the law of the deceased's domicile at the time of death. The form of the will may follow the law of your nationality or of the country where you sign it.

  • No will — six classes of heirs

Descendants; parents; full siblings; half siblings; grandparents; uncles and aunts. The closest class inherits, and parents share with the deceased's children. Adopted children and children acknowledged by the father inherit on an equal footing. With no heirs at all, the estate passes to the State.

  • The spouse's share

First, the spouse takes their own half of the marital property (sin somros). From the deceased's share, the spouse receives the same as a child; one half if there are no descendants but there are parents or full siblings; two thirds alongside half siblings, grandparents, uncles or aunts; everything if there are no other statutory heirs. All of this applies only to a registered marriage.

Source: Civil and Commercial Code, ss. 1457, 1625, 1635 (ThaiLawOnline)

  • Estate administrator

Named in the will or appointed by the court. The court is asked to appoint one, for example, when an heir lives abroad or is a minor. A minor, a person of unsound mind, a quasi-incompetent person or a bankrupt cannot be an administrator. Administration and distribution must be completed within 1 year unless the will, a majority of the heirs or the court sets another period.

Source: Civil and Commercial Code, ss. 1711, 1713, 1718, 1732 (ThaiLawOnline)

  • Condo: keep it or sell it

A foreign heir can keep the unit if they qualify under s. 19 of the Condominium Act (for example, hold Thai permanent residence or bring in foreign currency) and foreigners own no more than 49% of the total unit area in the building. Otherwise they notify the land office in writing within 60 days and sell the unit within 1 year.

Source: Condominium Act B.E. 2522, ss. 19, 19 bis, 19 quinque, 19 septem (Thailand Law Online)

  • Land — only with the Minister's permission

A foreigner who is a statutory heir can take land with the Minister's permission and within the area set by the Code. Without permission the land must be sold within a period set by the Department of Lands: 180 days to 1 year. If it is not sold, the Department sells it.

Documents for wills and estates

  • Passport
  • List of assets in Thailand: title deed for the condo or land, bank account numbers, car registration book, shares
  • Heirs' details: full name as in passport, date of birth, address
  • Details of the estate administrator, if you want to name one in the will
  • Marriage certificate, if you leave property to your spouse
  • Two adult witnesses who receive nothing under the will

For the court: appointing an administrator

  • Death certificate: Thai (มรณบัตร) or foreign, translated and legalised
  • The will, if there is one
  • Proof of relationship: marriage, birth or adoption certificates
  • Passports or ID cards of the heirs and of the proposed administrator
  • Thai house registration book or other proof of the deceased's address
  • Heirs' consent to the proposed administrator
  • List of assets with supporting documents: title deeds, bank statements

For the bank and the land office

  • Court order appointing the administrator and a certificate that it is final
  • Administrator's passport
  • Title deed for the condo or land
  • Deceased's bank book or account details
  • If there is no administrator — proof of each heir's right: relationship documents or the will
  • A foreigner keeping a condo — proof of eligibility under s. 19 of the Condominium Act

Based on the Civil and Commercial Code, Department of Lands rules and practical guides by Thai lawyers. The court, bank or land office may ask for more documents. Foreign documents need a Thai translation and legalisation; from 28 February 2027 an apostille replaces legalisation for documents from member countries of the Apostille Convention. Frequently asked questions

Can a foreigner make a will in Thailand?

Yes. Anyone may dispose of their property by will (s. 1646 of the Civil and Commercial Code). A foreigner's capacity to make a will is governed by the law of their nationality at the time the will is made (s. 39 of the Act on Conflict of Laws). Most people make a separate Thai will for their assets in Thailand and a will at home for everything else.

Is a will made in my home country valid in Thailand?

As to form, yes, if it follows the law of your nationality or of the country where you signed it (s. 40 of the Act on Conflict of Laws). But a Thai court needs it translated and legalised, and succession to real estate in Thailand still follows Thai law (s. 37). A separate Thai will saves your heirs extra steps.

Could a new will at home revoke my Thai will?

It could. Under Thai law a later will revokes an earlier one where they conflict, and it can also expressly revoke an earlier will entirely (ss. 1694 and 1697). If you are domiciled outside Thailand, revocation is governed by the law of your domicile at the time of revocation (s. 42 of the Act on Conflict of Laws). That is why each of your wills should state which assets it covers, and we check the revocation wording.

Can I make a will with a notary?

Thai law has no separate notarial will: a will is valid only in one of the forms set out in the Civil and Commercial Code (s. 1655). An ordinary written will is signed before two witnesses. You can also make a public will at the district office (amphur), where an official records your wishes; the amphur fee is from 250 THB.

What if an heir lives abroad?

That is one of the grounds on which the court appoints an estate administrator (s. 1713). Foreign death, marriage and birth certificates need a Thai translation and legalisation. The Apostille Convention enters into force for Thailand on 28 February 2027, which will simplify this for member countries.

How do heirs get money from the deceased's Thai bank account?

Banks usually freeze the account and release the money to an estate administrator appointed by the court. As a rule they want the court order and a certificate that it is final. We prepare the court petition and go to the bank with the administrator.

How is a condo or land transferred to an heir, and what does it cost?

For land, the Department of Lands service standard is as follows. If an administrator has been appointed by the court or by the will and is already registered on the title deed, registration takes about 130 minutes, not counting waiting time. With no administrator, the heirs apply themselves, the office posts a 30-day notice and the whole procedure takes about 47 days. If any heir is a foreigner or lives abroad, the land office usually asks for a court order. For both land and condos the fee is 0.5% of the appraised value for a spouse or a direct relative, and the general 2% rate for others.

Who inherits if there is no will?

Statutory heirs in order: descendants, parents, full siblings, half siblings, grandparents, uncles and aunts (s. 1629). A registered spouse inherits alongside any of these classes and takes everything if there are no other statutory heirs (s. 1635). With no heirs at all, the estate passes to the State (s. 1753).

Is there inheritance tax in Thailand?

Yes, but only on the amount above 100 million THB received from one deceased person (net of debts). The rate is 10%, or 5% for parents and descendants; a spouse pays nothing. A foreigner with Thai permanent residence pays on the whole inheritance, other foreigners only on assets in Thailand. The return is due within 150 days of receiving the inheritance (Inheritance Tax Act B.E. 2558, ss. 3, 11, 12, 14, 16, 17). The threshold is reviewed every 5 years, so we check it at the date of inheritance.

How much time do heirs have?

As a rule, a claim to the estate must be brought within 1 year of the death or of learning about it, and no later than 10 years after the death (s. 1754). There are exceptions, but do not wait: message us and we will assess the deadlines in your case.
