How should we reply?

Frequently asked questions

Do you represent only our side?

By default, yes. We act as a neutral intermediary for both parties only under a separate agreement with both of them.

Where do the meetings take place?

Anywhere in Thailand. Travel to another city is arranged in advance.

Will the partner know about the check?

Not necessarily. By law, anyone may inspect a company's documents held by the registrar and get certified copies for a government fee. The affidavit and copies are ordered through the DBD website or a bank — the company itself takes no part. If we need internal documents or a site visit, we agree with you in advance how to ask for them. We sign an NDA on request.

What can anyone see about a company?

The official DBD DataWarehouse+ database publishes company data and financial statements, as well as data on foreign investment in Thai companies. Directors and signing authority are on the DBD register, and shareholder names are on the บอจ.5 list. The DBD issues certified copies of these documents.

How long do I have to recover a debt?

It depends on the debt. A supplier's claim for goods delivered or work done is 2 years, or 5 years if they were for the debtor's own business. A number of claims for services are also 2 years. Interest arrears and rent for real estate are 5 years. The general period is 10 years. Send us the contract and invoices and we will work out your exact deadline.

The debtor admitted the debt in a message. Does that help?

It can. An acknowledgment of the debt — in writing, by part payment, by paying interest or by giving security — interrupts prescription, and a new period starts (CCC, ss. 193/14, 193/15). We will review the messages: who wrote them and what exactly they admit matters. Keep the messages and bank confirmations.
